When a group saw the distribution of assessments in their HOA were not fair, they approached the board with their concerns. After the board told them they were interpreting the CC&R's incorrectly and to go to court if they disagreed, they did and the judge agreed with the group. The judge also ordered that the HOA would have to pay all legal fees in the amount of $90,000.
